If you are using or planning to use Halo 3 ODST before release, be warned. Microsoft are "Investigating a very small breach in our distribution process around the early delivery of 'Halo 3: ODST' units". Also be warned that "We are also investigating Xbox Live accounts that show activity related to Halo 3: ODST and will take action against those we believe have procured copies of the game illegitimately."

If ODST is in someone's recent games, it's pretty obvious that they've added the game or played it pre-release

It was released early in France on accident,and they got banned for legitimately buying the game and playing it,so of course you'd get banned for this.

I Still say its a load of B.u.l.l.S.h.i.t lol me and four other people
haven been playing it since the day it was leaked and we aren't banned.
even if we do get banned i know two of use have other accounts & Xbox's lol
and i've been banned plenty of times so i could care less

Just because you haven't been banned, doesn't mean you won't. I personally know 7 people that have been banned. and 3 more locally. You will get banned it's not a matter of if, it's a matter of when.

The way to circumvent old xbox's is by sacrificing ANOTHER xbox, so it's not really "going around" a ban because now that second box is useless for accessing live. The way your suggesting is along the same lines, sacrificing another xbox, and still, not "going around".
